Who controls the processing of data?

Which of your data are processed by us? And for which purposes?

If we received data from you, we will generally only process them for the purposes for which we received or collected the data.

Data may only be processed for other purposes if the mandatory legal requirements pursuant to Art. 6 para. 4 GDPR are met. Of course, we will comply with any duties to provide information pursuant to Art. 13 para. 3 GDPR and Art. 14 para. 4 GDPR in this case.

What is the legal basis for such processing?

Unless there are more specific legal provisions, the legal basis for processing personal data is generally provided by Art. 6 GDPR. Here, the following situations may apply:

  • Consent (Art. 6 para. 1 lit. a) GDPR)
  • Data processing for the performance of a contract (Art. 6 para. 1 lit. b) GDPR)
  • Data processing based on a weighing of interests (Art. 6 para. 1 lit. f) GDPR)
  • Data processing to fulfil a legal obligation (Art. 6 para. 1 lit. c) GDPR)

If personal data are processed based on your consent, you have the right to revoke your consent at any time with effect for the future.

If we process data based on a weighing of interests, you, the data subject, have the right to object to the processing of personal data in consideration of the provisions set out in Art. 21 GDPR.

How long are the data stored?

We will process the data as long as necessary to fulfil the relevant purpose.

If there are legal requirement to preserve records, for example under trade or tax laws, the affected personal data will be stored for the mandatory period for preserving records. After the requirement to preserve records expires, we will review whether any further processing is necessary. If no further processing is required, the data will be deleted.

Generally, we check data around the end of a calendar year to determine whether any further processing is required. Due to the volume of data this check is carried out in regard to specific data types or purposes of processing.

Of course, you may request information about your stored personal data at any time and you may request that we delete the data or limit processing if the data are no longer required.

To which recipients are the data transferred?

Generally, personal data are only disclosed to third parties if required for the performance of the contract concluded with you, such disclosure is permissible based on a weighing of interests within the meaning of Art. 6 para. 1 lit. f) GDPR, we are obligated to disclose the data under applicable law or you have given your consent.

Where are the data processed?

Your personal data will only be processed within computing centres located in the Federal Republic of Germany.

Your rights as a “data subject“

You have the right to information about your personal data processed by us.

Please understand that we may request proof of identity from you to confirm that you are the person who you say you are if you do not request information in writing.

Furthermore, you are entitled to have your data corrected or deleted or to limit processing provided you have these rights under applicable law.

In addition, you have a right to object to the processing in compliance with statutory requirements. The same applies to a right to data portability.

In particular, you have a right to object to the processing of your data under Art. 21 para. 1 and 2 GDPR in connection with direct advertising if is based on a weighing of interests.
